REGULAR MEETING

AUGUST 14, 2017

 

 

The Titus County Commissioners’ Court, after notice posted in the manner, form and contents as required by law, met in Regular Meeting on Monday, August 14, 2017 at 9:00 a.m. in the Titus County Courtroom, Room 205, located at 100 West 1st Street with the following members present:

PLEDGE OF ALLEGIANCE:  Judge Brian Lee

1.      PUBLIC COMMENTS AND/OR REQUESTS FOR INFORMATION ON NON-AGENDA ITEMS IN ACCORDANCE WITH SECTION 551.042, TEXAS OPEN MEETINGS

Sheriff Ingram updated the Court on the use of sheriff’s vehicle for temporary traffic control on I-30 to TxDOT while they were working on bridges and guardrails.  The use of vehicle brought in approximately $6100.00 and he thanked the Court for approving.

 

2.      CONSIDER AND POSSIBLY APPROVE MINUTES FROM JULY 24, 2017 SPECIAL  MEETING OF THE COMMISSIONERS’ COURT

Motion was made by Commissioner Parker and seconded by Commissioner Fields to approve minutes from July 24, 2017 special meeting of the Commissioners’ Court.  Motion passed unanimously.

 

3.      CONSIDER AND POSSIBLY APPROVE A DONATION FROM WALMART TO THE CONSTABLES’ OFFICES IN THE AMOUNT OF $2500

Constable Chris Durant informed the Court that the donation was from Pilgrims’ Pride and was for four (4) patrol rifles and racks to be installed in each car.

 

Motion was made by Commissioner Applewhite and seconded by Commissioner Parker to approve a donation from Pilgrims’ Pride to the Constables’ offices in the amount of $2500.00.  Motion passed unanimously.

 

4.      CONSIDER AND POSSIBLY APPROVE KENNETH L. SCHMITT AS A RESERVE DEPUTY CONSTABLE, PRECINCT 1 (CHRIS DURANT)

Motion was made by Commissioner Parker and seconded by Commissioner Applewhite to approve Kenneth L. Schmitt as a Reserve Deputy Constable, Precinct 1.  Motion passed unanimously.

 

5.      CONSIDER AND POSSIBLE TAKE ACTION ON CONSTRUCTION/REPAIR PROJECTS TO INCLUDE:

A.     WEST WALL OF ANNEX – bid is to be received today.  Commissioner Riddle would like to remove the electrical and landscaping off of the wall before repairing stucco. 

B.      NORTH COURTHOUSE ENTRANCE WATER LEAK – to get bid today to seal water leak.  Commissioner Riddle does not think that it is a structural issue.

C.      NORTH ANNEX ENTRY DOORS – Bid has been received from Taylor Glass in the amount of $5200.00 and waiting on bid from Brown Glass.  Bid consists of changing doors by eliminating middle door in the interior and changing outside doors to one central entrance. 

Motion was made by Commissioner Fields and seconded by Commissioner Parker to give Commissioner Riddle the authority to change first set of exterior doors based on his proposal and price.  Motion passed unanimously.

D.     EXTENSION OFFICE ROOF LEAK – Hefner Roofing to repair roof leak for $2400.00 and is to start work this morning.

E.      FLAG POLE Commissioner Riddle is to get with Veteran Service Officer, Steve Austin.

 

6.      PUBLIC HEARING FOR TITUS COUNTY CLERK’S OFFICE RECORDS ARCHIVAL PLAN FOR FY 2018 (JOAN NEWMAN)

Public hearing began at 9:24 a.m. for Titus County Clerk’s Office Records Archival Plan for FY 2018.  County Clerk, Joan Newman, explained the statue, purpose, revenue and restoration and preservation projects for the FY 2018 as per attached.  The cost to digitally restore and electronically index old Titus County Deed Records Volumes 35-40 will be $26,000.00.  (SEE ATTACHMENT 01)

 

Public Hearing ended at 9:28 a.m. and Commissioners’ Court resumed its meeting.

 

7.      CONSIDER AND POSSIBLY APPROVE ORDER TO ADOPT RECORDS ARCHIVAL PLAN (JOAN NEWMAN)

Motion was made by Commissioner Fields and seconded by Commissioner Parker to approve order to adopt Records Archival Plan for FY 2018.  Motion passed unanimously.  (SEE ATTACHMENT 02)

 

8.      CONSIDER AND POSSIBLY APPROVE PROFESSIONAL SERVICES AGREEMENT BETWEEN TITUS COUNTY CLERK AND IDOCKET.COM RUBY SERVICE (JOAN NEWMAN)

Motion was made by Commissioner Fields and seconded by Commissioner Applewhite to approve Professional Services Agreement between Titus County Clerk and IDocket.com Ruby Service.  Motion passed unanimously.  (SEE ATTACHMENT 03)

 

9.      CONSIDER AND POSSIBLY APPROVE 2018 TITUS COUNTY SHERIFFS’ AND CONSTABLES’ FEES

Motion was made by Commissioner Riddle and seconded by Commissioner Applewhite to approve 2018 Titus County Sheriffs’ and Constables’ fees.  Motion passed unanimously.  (SEE ATTACHMENT 04)

 

10.  CONSIDER AND POSSIBLY APPROVE ANNUAL HARDWARE IT SUPPORT LEVEL II MAINTENANCE AGREEMENT WITH NET DATA

Motion was made by Commissioner Parker and seconded by Commissioner Fields to approve annual hardware IT Support Level II Maintenance Agreement with NET Data.  Motion passed unanimously.  (SEE ATTACHMENT 05)

 

11.  CONSIDER AND POSSIBLY APPROVE THE PURCHASE OF NET DATA COMPUTER MODULES FOR THE COUNTY ATTORNEY’S OFFICE WITH AN INITIAL ONE-TIME COST OF $35,300 AND ANNUAL COST OF $9000

Motion was made by Commissioner Fields and seconded by Judge Lee to approve the purchase of NET Data Computer Modules for the County Attorney’s office with an initial one-time cost of $35,000 and annual cost of $9000.  Motion passed unanimously.  (SEE ATTACHMENT 06)

 

12.  CONSIDER AND POSSIBLY APPROVE TERRI AYDELOTT AS TEMPORARY JUSTICE OF THE PEACE, PRECINCT 2, WHILE JUDGE DYKE IS ON MEDICAL LEAVE

Motion was made by Commissioner Fields and seconded by Commissioner Riddle to ratify decision to approve Terri Aydelott as temporary Justice of the Peace, Precinct 2, while Judge Dyke is on medical leave.  Motion passed unanimously.

 

13.  CONSIDER AND POSSIBLY APPROVE STATUTORY PAYROLL ADJUSTMENT FOR JUDGE AYDELOTT DURING JUDGE DYKE’S ABSENCE

Motion was made by Commissioner Fields and seconded by Commissioner Parker to approve statutory payroll adjustment for Judge Aydelott during Judge Dyke’s absence.  Motion passed unanimously.

 

14.  CONSIDER AND POSSIBLY APPROVE TRAVEL AND SEMINARS FOR TITUS COUNTY EMPLOYEES AND ELECTED OFFICIALS

Motion was made by Commissioner Parker and seconded by Commissioner Applewhite to approve travel and seminars for Titus County employees and elected officials.  Motion passed unanimously.  (SEE ATTACHMENT 07)

 

15.  APPROVE ORAL AND WRITTEN REPORTS OF COUNTY OFFICIALS

Motion was made by Commissioner Parker and seconded by Commissioner Fields to approve oral and written reports of county officials.  Motion passed unanimously.  (SEE ATTACHMENT 08)

 

16.  CONSIDER AND POSSIBLY APPROVE TREASURER’S REPORT

Motion was made by Commissioner Fields and seconded by Commissioner Applewhite to approve Treasurer’s report.  Motion passed unanimously.  (SEE ATTACHMENT 09)

 

17.  APPROVE BUDGET AMENDMENTS

There were no budget amendments.

 

18.  SIGN PAY ORDERS AND APPROVE PAYMENTS

Motion was made by Commissioner Applewhite and seconded by Commissioner Parker to sign pay orders and approve payments.  Motion passed unanimously.  (SEE ATTACHMENT 10)

 

19.  REPORT FROM ROAD ENGINEER (ROGER LEDBETTER)

Roger Ledbetter reported to the Court that he had received complaints as to the tall grass and brush.  They are currently mowing a 15’ strip on each side of the road which is less than normal.  They will come back in the fall and mow.  They are side cutting and spraying herbicides 15’ high and down at the intersections.

 

The base has been completed on CR 3375, CR 3340, CR 3335 and CR 3370.  Work has been delayed due to weather.

 

Maps with the roads highlighted that needed repairs were given to each Commissioner for them to prioritize which roads to work on first.  (SEE ATTACHMENT 11)

 

20.  COUNTY JUDGE REQUESTS AN EXECUTIVE SESSION PURSUANT TO TEXAS GOVERNMENT CODE SECTION 551.074 TO DISCUSS PERSONNEL MATTERS

Commissioners’ Court went into Executive Session at 10:38 a.m. and reconvened regular meeting at 11:31 a.m.  No action taken.

 

21.  CLOSING COMMENTS BY COUNTY JUDGE AND COMMISSIONERS, IF ANY

Judge Lee questioned the status of the tire recycling and Commissioner Applewhite answered in that he needs to schedule a time that both the Sheriff’s office and the company from Paris can get together. 

 

Judge Lee is to meet with Steve Capps and Toni Melton regarding county health insurance.  He has received a quote from Texas Association of Counties for health insurance.  A decision is to be made whether to continue with self-funded insurance for the county or change to a traditional plan.

 

Judge Lee called for a recess at 10:30 a.m. and reconvened at 10:38 a.m. in order to go into Executive Session.
